Agreement and Effective Trigger Upon purchasing and receiving the delivery of the Talkpod device, you are deemed to have read and provisionally accepted this Acceptable Use Policy (hereinafter referred to as the "Policy" or "AUP"). If you do not agree to any term or condition of this Policy, you must request a return before powering on and activating the device on the network. By powering on the device, successfully connecting to the network, and logging into the VHAM platform, you (and any organization you represent) expressly and irrevocably agree to:
  1. Fully abide by all terms and conditions of this Policy;

  2. Accept any reasonable future updates or modifications made by Talkpod to this Policy;

  3. Exercise self-regulation and strictly adhere to the civil communication conventions of VHAM default groups and Public Groups.

1. Global Applicability and Local Compliance The VHAM platform provides borderless global push-to-talk (PTT) services. Our hardware and cloud services operate under the legal constraints and technical specifications generally applicable to smartphones and basic cellular mobile networks.

  • User Due Diligence: The VHAM service is accessible globally. Prior to purchasing and using this product, you are solely responsible for understanding, evaluating, and strictly complying with the specific laws, regulations, and radio/telecommunications ordinances of your local jurisdiction.

  • Conflict of Laws: If any provision of this Policy conflicts with your local laws and regulations, you must immediately cease using the device and proactively contact our support department (support@talkpod.com) to address the compliance conflict. You pledge to always use the cellular-based VHAM radio within a compliant and legal framework.

2. Prohibited Activities To ensure the quality of the communication experience for all VHAM users, you expressly agree and warrant that you will NEVER use our services to engage in or facilitate any of the following activities:

  • Illegal and Dangerous Activities: Using the service to conduct, plan, or promote any activities that violate local, national, or international laws (including, but not limited to, trafficking of illicit goods, violent acts, or terrorism).

  • False Alarms and Interference with Public Safety: Intentionally broadcasting false distress signals (e.g., "Mayday") or fake disaster alerts in public or private groups, or attempting to interfere with or intercept the lawful communications of local law enforcement and emergency responders (e.g., 911/112).

  • Hate Speech and Extremist Content: Transmitting any defamatory, threatening, intimidating, or highly offensive voice messages, or broadcasting hate speech based on race, religion, sexual orientation, or national origin within VHAM Public Groups.

  • Malicious Jamming and Technical Abuse:

    • Maliciously and continuously occupying communication channels (e.g., "dead-keying" or intentionally locking the PTT button to prevent others from speaking).

    • Intentionally broadcasting high-frequency screeching noises, disruptive audio, or meaningless recordings to jam other users.

    • Utilizing unauthorized third-party bots, automated scripts, or reverse-engineering methods to access the VHAM network.

3. Public Groups Disclaimer The VHAM platform allows users to join global public groups via numeric codes. You fully understand and agree that voice communications within public groups are entirely public. Talkpod cannot proactively monitor, review, or endorse any statements made by global users in public channels in real-time. Your participation in public groups is strictly at your own risk. Talkpod and its affiliates expressly disclaim any and all liability for any offensive, inappropriate, or unlawful content you may hear in public channels.

4. Disclaimer for Mission-Critical and Life-Saving Operations The VHAM service is inherently dependent on the connectivity of third-party cellular networks (e.g., AT&T, T-Mobile, Vodafone) and the global internet. This service is NOT designed, intended, or authorized for use in "Mission-Critical" or "Life-Saving" scenarios, nor can it serve as a replacement for official emergency dispatch systems (such as the 911 dispatch system). Talkpod shall bear no joint or several liability for any direct, indirect, incidental, or consequential business losses, personal injury, loss of life, or property damage resulting from service interruptions, latency, or disconnections caused by network blind spots, third-party cell tower failures, international roaming restrictions, natural disasters, or routine platform maintenance.

5. Enforcement and Termination Rights Talkpod reserves absolute and sole discretion in determining what constitutes a violation of this AUP. If you or any device within your organization violates this Policy, we reserve the right to take any of the following actions without prior notice:

  • Immediately suspend or permanently ban the offending device's IMEI, SIM card (ICCID), or VHAM account access.

  • Terminate the provision of services, with no refunds issued for any device purchases or annual data subscription fees paid.

  • Cooperate fully with law enforcement agencies in the event of a significant threat to public safety or upon lawful request from local judicial authorities.

6. Reporting Abuse We are committed to maintaining a professional and friendly global communication ecosystem. If you encounter any severe violations of this Policy (such as malicious jamming or illegal activities) in any VHAM group, please note the specific "Group ID" and the time of the incident, and report it to our Trust & Safety Team by emailing support@talkpod.com.
